LEGISLATION THAT APPLIES TO ALL BUSINESSESEnvironmental Protection Act 1990: this requires all businesses to ensure that any waste you produce is handled safely and in a way that complies with The Duty of Care Regulations and other subsequent legislation. The Duty of Care Regulations: these require businesses to, store their waste in appropriate containers so that it does not escape into the environment; transfer the waste only to another person or company that has a waste carriers licence; obtain a waste transfer note from their waste company when waste is collected, and ensure that the final destination of their waste, whether for recycling or disposal, has the relevant waste management licences. Landfill Directive: this bans certain wastes from being sent to landfill, including tyres, liquid wastes, mixed hazardous and non-hazardous wastes and wastes which are flammable or corrosive and it requires all businesses to pre-sort their waste for recycling or other treatment, or pay their waste contractor to pre-sort the waste for recycling before any can be sent to landfill.OTHER WASTE LEGISLATIONHazardous Waste Regulations: place strict requirements on businesses that produce such waste, on how the waste is stored, who is able to collect it, what must be done to dispose of it or treat it legally and what records must be kept. Packaging, Waste Electrical, End of Life Vehicle and Battery Directives: gives recycling and recovery targets to all producers and retailers that sell packaging, electrical goods, vehicles and batteries and sets out how the targets must be met. Animal By-Products (ABP) Regulations: sets out how all food waste must be collected and treated. |
